Medicenta Terms and Conditions
These Terms and Conditions (“Terms”) govern your use of the Medicenta platform (“Platform”), accessible via web and mobile applications. By accessing or using the Platform, you agree to comply with these Terms. If you do not agree to these Terms, you must refrain from using the Platform.
General Provisions
Platform Purpose:
Medicenta provides a digital healthcare marketplace and directory that connects users with healthcare providers, products, and services, including telemedicine consultations, medical product purchases, and appointment scheduling. Medicenta does not provide healthcare services directly.
Definitions:
- “User” refers to any individual or entity using the Platform to access or offer services, including healthcare providers, vendors, and individual customers.
- “Vendor” refers to healthcare providers, pharmacies, laboratories, gyms, spas, and other organizations or individuals offering services or products through the Platform.
- “Medicenta” refers to the owners and operators of the Platform.
User Responsibilities
Eligibility:
- Users must be at least 18 years old or the legal age of majority in their jurisdiction to use the Platform.
- Vendors must provide accurate and verifiable licensing and documentation as required by law.
Registration:
- All Users must register an account and provide accurate, complete, and up-to-date information.
- Users are responsible for maintaining the confidentiality of their account credentials.
Prohibited Activities:
Users may not:
- Use the Platform for unlawful, fraudulent, or harmful purposes.
- Post false, misleading, or defamatory information.
- Breach applicable healthcare laws or data protection regulations.
Platform Services
Service Listings:
- The Platform allows Users to search for and purchase services, such as healthcare consultations, laboratory tests, gym memberships, and medical products.
- All services and products are subject to availability.
Telemedicine:
- Telemedicine consultations provided via the Platform do not replace in-person medical care. Users should seek emergency care in life-threatening situations.
- Users are responsible for providing accurate medical information during consultations.
Payments:
- Payments for services and products must be made through the Platform.
- All transactions are processed securely. Medicenta does not hold funds but facilitates payment processing.
Logistics:
- Medicenta does not handle product deliveries. Users are responsible for confirming delivery details directly with Vendors.
Health Records:
- The Platform securely stores Users’ health records, which are accessible only to authorized Users and healthcare providers.
- Medicenta is not liable for misuse or unauthorized access caused by Users sharing their credentials.
Vendor Obligations
Licensing and Compliance:
- Vendors must provide valid licenses and certifications during registration and comply with all applicable laws and regulations.
- Vendors must ensure that their products and services meet quality and safety standards.
Service Listings:
- Vendors are responsible for accurately describing their services and products, including pricing and availability.
- Any updates to listings must be made promptly to avoid misinformation.
Ratings and Reviews:
- Vendors may receive reviews and ratings from Users. Medicenta does not alter these reviews unless they violate our content policies.
Fees and Subscriptions
Listing Fees:
- Vendors are required to pay listing fees to display their services and products on the Platform. Failure to pay may result in suspension or removal of listings.
Commissions:
- Medicenta charges a percentage commission on transactions processed through the Platform. The percentage will be communicated during Vendor registration.
User Reviews and Ratings
Transparency:
- Users may leave reviews and ratings about services and products. These reviews are publicly visible on the Platform.
Prohibited Content:
- Reviews containing offensive, defamatory, or false information will be removed.
Data Privacy and Security
User Data:
- Medicenta collects and processes personal data in accordance with its Privacy Policy.
- Sensitive health information is encrypted and stored securely.
Vendor Data:
- Vendors are responsible for safeguarding customer information accessed through the Platform.
AI Features:
- Medicenta may use AI for inventory management, customer support, and other features. Users consent to the use of AI when accessing such services.
Limitations of Liability
No Medical Advice:
- Medicenta is not a healthcare provider and does not offer medical advice. The Platform facilitates access to healthcare providers but is not liable for the quality or outcomes of medical services.
Third-Party Services:
- Medicenta is not responsible for the actions, omissions, or negligence of Vendors or third-party logistics providers.
Platform Downtime:
- Medicenta does not guarantee uninterrupted access to the Platform and is not liable for damages caused by technical issues or downtime.
Dispute Resolution
Vendor and User Disputes:
- Medicenta is not a party to disputes between Users and Vendors but may facilitate resolution in accordance with its internal policies.
Arbitration:
- Disputes between Users and Medicenta will be resolved through binding arbitration under Nigerian law.
Modifications to Terms
Medicenta reserves the right to modify these Terms at any time. Changes will be communicated to Users through the Platform or email. Continued use of the Platform after such updates constitutes acceptance of the new Terms.
Governing Law
These Terms and Conditions, and the rights and obligations of the parties to the Contract shall be governed, interpreted and construed by the Nigerian Laws without regards to its conflict of law provisions.
